PD3: Estate planning and distribution of death benefits

With millions of Australians holding life insurance through their superannuation, super funds play a key role in the payment of death benefits in Australia. This workshop will take you through the breadth of investigation required to determine rightful beneficiaries and address the difficult issues that can arise during the process.

The purpose and benefit of having clear and appropriate estate planning requirements in place, including enduring powers of attorney and wills, will be reviewed. The complications that may arise when appropriate arrangements are not in place will also be considered.

Participants will benefit from the valuable insight of Lisa-Marie McKechnie, a specialist financial services lawyer with Mills Oakley.

  • Superannuation death benefits and the Trustee decision making process
  • Dealing with the financial and medical matters of an acquaintance
  • Instructing how estate assets are distributed and to whom

  • Describe the impact of beneficiary nominations on the distribution of death benefits 
  • Summarise the rules regarding payment of superannuation death benefits
  • Explain the benefits of having a properly constructed and up to date will
  • Outline the purpose of an enduring power of attorney
  • Discuss the issues that may arise when estate planning requirements are not in place
