Hawking Prohibitions and the Spam Act

While member acquisition and retention is on the top of all funds’ radars, there are rules in place which limit the circumstances in which members and employers can be contacted.

Hawking prohibitions generally prohibit unsolicited telephone calls and meetings and the Spam Act forbids the sending of commercial electronic messages where consent has not been provided by the receiving party.

This 1.5 hour workshop will address exactly what a fund and its representatives should do to adhere to Hawking Prohibitions and the Spam Act as well as compliance and best business practices.

Key topics include:

  • The concept of hawking and distinguishing between solicited and unsolicited requests
  • Applying principles within the hawking prohibitions and the Spam Act to client contact scenarios
  • The types of communications prohibited under the Spam Act and what you must do to comply
